WAIVER, RELEASE OF CLAIMS AND ASSUMPTION OF RISK
I understand that The Barkann Family Healing Hearts Foundation is committed to conducting their event in a safe manner and holds the safety of participants in the highest regard. I understand that The Barkann Family Healing Hearts Foundation continually strives to reduce such risks and insists that all participants follow safety rules and instructions that are designed to protect the participant’s safety. I also understand, however, that participants and parents/guardians or minors registering for the event recognize that there is inherent risk of physical injury when choosing to participate in the event. I am solely responsible for determining if I am (or my minor child/ward is) physically fit and/or sufficiently skilled for the event. I recognize and acknowledge that there are risks of physical injury to participants in the event and I freely and voluntarily agree to assume the full risk of any and all injuries, damages or loss, regardless of severity that I (or my child) may sustain as a result of said participation. I approve my (or my child’s) participation in the event. I assume all risks and hazards incidental to such participation in the event, and I release, absolve, indemnify, and agree to hold harmless The Barkann Family Healing Hearts Foundation, it’s founders, its Board of Directors, past and present employees, agents, representatives, assigns, administrators, executors, volunteers and all county and state governments, and all event sponsors, for any claim arising out of an injury to me (or my child) and from any and all claims, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs or expenses of whatsoever kind, nature, or description, whether direct or indirect, in law or in equity, in contract or in tort, or otherwise, whether known or unknown, arising out of or connected with my (or my child’s) participation in the event.
I acknowledge that I have read and fully understood the important information above, including the warning of risk, assumption of risk and waiver and release of all claims and that I have carefully analyzed, accepted and agreed to the terms of this waiver and release and sign on my own free act and deed, and that I understand that I have given up legal rights by signing it.
I acknowledge that my participation in the event WILL BE DENIED if my electronic signature or the electronic signature of my parent/guardian (if I am under the age of 18) does not appear on my registration form prior to my participation in the event.
I further acknowledge that my electronic signature or the electronic signature of my parent/guardian (if I am under the age of 18) has the full force and effect of a signature affixed by hand to a paper document.
